Proposed Regulations and Fee Schedule
At its Aug. 17, 2026 meeting, the Nebraska Medical Cannabis Commission (MCC) voted to move forward with proposed amendments to its regulations and a proposed fee schedule.
Formal Rulemaking Process
The Commission’s approval of the proposed regulations does not make the regulations effective. It authorizes the proposed regulations to move forward through the formal rulemaking process required under the Nebraska Administrative Procedure Act.
The formal rulemaking process generally includes:
- Legal review and preparation of the proposed regulations (completed);
- Publication of the proposed regulations and notice of the rulemaking process;
- An opportunity for public comment, including a public hearing as required by law;
- Review of public comments and consideration of any additional changes;
- Preparation and approval of the final rulemaking package;
- Review and approval by the Attorney General and Governor, as required by law; and
- The regulations becoming effective as provided by law following final approval.
The proposed regulations are not currently in effect. Until the rulemaking process is completed and the regulations become effective, the Commission will continue operating under the current licensing and renewal structure, including the current six-month renewal schedule.
Public Comment and Hearing
The formal rulemaking process will provide an opportunity for the public to review the proposed regulations and submit comments. A public hearing will also be held as required by law. Information will be available on the MCC and Public Meeting Calendar websites.
A public hearing held as part of the rulemaking process is separate from the Commission’s regular public meetings, where Commissioners are present and public comment is received, and a separate public hearing held as part of the rulemaking process. There is no requirement that Commissioners attend a public hearing for the purposes of receiving public comment to proposed rulemakings. MCC staff will facilitate the hearing, document the comments received, and maintain the official record. The comments will then be provided to the Commission for consideration as part of the rulemaking process.
Depending on the comments received and any changes made to the proposed regulations, additional rulemaking steps or another public hearing may be required.
If the Commission adopts the regulations, they will then be submitted to the Attorney General's office for review and, following Attorney General approval, to the Governor for approval. If approved by the Governor, the regulations will become effective as provided by law five days after his approval.
Proposed Fee Schedule
The Legislature authorized the Commission to establish fees by regulation in April 2026, with fees of up to $50,000 per fee. The proposed fee schedule is being considered as part of the formal rulemaking process.
The Commission cannot begin collecting the proposed fees until the applicable regulations have been formally adopted, signed by the Governor, and five days have passed since signing.
Until then, the Commission will continue operating under the current licensing and renewal structure, which means licenses will continue to be renewed every six months.

The regulations linked below are the current permanent Nebraska Medical Cannabis Commission regulations. These regulations completed the required review and approval process, including approval by Attorney General Mike Hilgers on June 30, 2026, and approval by Governor Jim Pillen on July 1, 2026.
