Proposed Regulations and Fee Schedule

At its Aug. 17, 2026 meeting, MCC voted to move forward with the Proposed Amendments to the Regulations, which are currently going through the formal rulemaking process required by Nebraska law. Until the rulemaking process is completed and the regulations become effective, the Commission will continue operating under the current licensing and renewal structure, including the current six-month renewal schedule.

Public Hearing

MCC will hold a public hearing on the proposed regulations on October 15, 2026, to receive comments on the proposed amendments to the Nebraska Medical Cannabis Commission’s regulations. The proposed amendments primarily establish application, registration, renewal, and other fees.

The hearing is an opportunity for the public to provide feedback on the proposed changes. Participants are encouraged to review the proposed amendments before the hearing and focus their comments on specific provisions they would like the Commission to consider changing, clarifying, adding, or removing. Comments regarding the proposed fee schedule are also welcome.

Date: Oct. 15, 2026
Time: 1 p.m.– 4 p.m., or until there are no additional speakers, whichever comes first

Participants are strongly encouraged to bring written copies of their comments. Oral comments will generally be limited to three minutes per speaker. If participation requires it, the Commission reserves the right to reduce the time limit to two minutes.

Due to limited capacity, speakers are respectfully asked to vacate the premises after completing their testimony so that others may participate.

MCC staff will facilitate the hearing, document the comments received, and maintain the official rulemaking record. All comments received will be compiled and provided to the Commission for consideration as part of the formal rulemaking process.

The rulemaking public hearing is a formal step in the rulemaking process and is separate from the Commission’s regular public meetings. Commissioners are not required to attend a rulemaking public hearing. Following the hearing, the Commission will review the comments received and consider whether additional changes to the proposed amendments are appropriate.

Depending on the comments received and any changes made to the proposed regulations, additional rulemaking steps or another public hearing may be required. If the Commission adopts the regulations, they will then be submitted to the Attorney General's office for review and, following Attorney General approval, to the Governor for approval. If approved by the Governor, the regulations will become effective as provided by law five days after the Governor's approval.

The regulations linked below are the current permanent Nebraska Medical Cannabis Commission regulations. These regulations completed the required review and approval process, including approval by Attorney General Mike Hilgers on June 30, 2026, and approval by Governor Jim Pillen on July 1, 2026.
