The Commission’s current emergency regulations are in the process of being formalized following a public rulemaking process. As part of this process, a public comment hearing was held on February 26, 2026, in Lincoln, Nebraska, where stakeholders had the opportunity to provide input on the proposed regulatory changes.

Notice of the hearing was published on January 25, 2026, in the Lincoln Journal Star. The Commission is currently reviewing feedback received during the comment period as it works to finalize the regulations.

At this time, the proposed and existing emergency regulations, referred to as the 238 NAC Emergency Regulations, continue to guide the medical cannabis program while the formalization process is ongoing. 

Below you can view the Commission’s current emergency regulations alongside the proposed regulations. At this time, they are the same, so there are no changes between the two.
